Purpose and scope

We are committed to conducting business with individuals and organizations who act in accordance with internationally recognized industry standards of:

• business ethics
• safe and healthy workplaces
• social and environmental responsibility

We require that all individuals and organizations that provide services or produce goods for us (“suppliers”) meet or exceed the minimum standards described in our Supplier Code of Conduct (SCC).

• Suppliers must ensure that their subcontractors also comply with the SCC.
• Suppliers must carefully review and agree to the terms of the SCC as a condition of doing business with us.
• They must record their compliance with the SCC and disclose relevant information to us upon request.
• We will monitor compliance by suppliers with the standards of the SCC.

Ethical expectations

We expect all suppliers to commit to ethical business practices and act with honesty, fairness, respect and integrity.

Suppliers will not, directly or indirectly, engage in corruption, bribery, kick-backs, extortion or embezzlement or any business practices or conduct that is in breach of applicable laws, or any conduct that would put MPAC at risk of breaching applicable laws.

Monitoring and enforcement procedures will be implemented to ensure compliance with applicable anti-corruption laws, including the Corruption of Foreign Public Officials Act (Canada).

Health and safety

• Suppliers will provide their personnel safe and healthy workplaces in compliance with all applicable laws.
• They will take all reasonable steps to prevent accidents and injuries related to work and the facilities where work is performed.
• Suppliers will identify and control personnel’s exposure to harmful or hazardous materials, and biological, chemical and physical agents.
• Suppliers will also provide adequate safety training, and written health and safety guidelines, to their personnel.

Environmental

Suppliers will promote environmental sustainability and conduct business in an environmentally responsible manner while working to minimize their environmental impact.

All legally required environmental permits, approvals and registrations must be obtained, maintained and kept current, and their operational and reporting requirements must be followed.

Labour and human rights

Suppliers will:

• Treat their personnel with dignity and respect and will not permit any physical, sexual, verbal or psychological violence or harassment or abuse.
• Respect the diversity of their personnel and others with whom they interact and comply with all applicable laws relating to human rights, accommodation and accessibility.
• Consider all personnel on the basis of their qualifications and abilities.
• Subject to applicable human rights laws, not employ any individuals under the age of 16, unless local minimum age law stipulates a higher age for work or mandatory schooling, in which case such the higher age would apply.
• Ensure that personnel do not perform work that may jeopardize their health or safety.

Suppliers will not:

• Use any forced, illegal, unauthorized or prison labour.
• Require any personnel to lodge identity papers (except where required by applicable laws) or deposits as a condition of work, or financially penalize personnel for resigning.
• Discriminate or permit differential treatment (except where legitimate occupational requirements are permitted by applicable law) in:
  • hiring
  • compensation
  • access to training
  • promotion
  • termination on the basis of:
    • race
    • ancestry
    • citizenship
    • ethnic origin
    • age
    • gender
    • sexual orientation
    • marital or family status
    • disability
    • religion
    • creed

Hours of work

Suppliers will not require their personnel to work more than the hours permitted by the laws of the jurisdiction where the workers are employed.

• The regular work week will not exceed 48 hours.
• The total of regular and overtime work will not exceed 60 hours per week except in exceptional and unforeseen circumstances, unless applicable laws allow fewer hours.
• Personnel will have consented to any overtime and are compensated according to requirements of applicable laws.
• Where the law is silent on overtime pay, suppliers will compensate their personnel for overtime at a premium rate.
• Except in emergency situations, suppliers’ personnel must have at least one day off every seven days or such greater time as is required by applicable laws.

Labour laws

Suppliers will ensure that all compensation complies with applicable minimum wage laws or the prevailing rate, whichever is higher, and will provide all legally mandated benefits.

Suppliers will respect freedom of association and collective bargaining.

Where the right to freedom of association and collective bargaining is restricted under applicable law, Suppliers will not hinder the development of parallel means for independent and free association and bargaining.
